Orchard is committed to protecting and maintaining your privacy. This privacy policy (the “Privacy Policy”) discloses the types of information that we collect from you through the www.orchardsoft.com, portal.orchardsoft.com, pc.orchardsoft.com websites and any supporting systems, including but not limited to any associated content libraries and learning management tools (collectively, the “Website”), how that information will be stored and used by Orchard and shared with others.

Information Collection and Use

Orchard collects information from you at several different points on the Website and is the sole owner of the information collected. Your information is not shared with any other entity without your permission, except under conditions listed below:

  • Orchard is required to do so by law, or in urgent circumstances, to protect personal safety, the public, or our Website.

Registration

The majority of the Website is available to all web users. However, in order to use the customer-only section of the Website, you must meet the requirements and use the standard account request process for access. Accounts are generally limited to Orchard employees and customers who maintain a current support contract with Orchard. However, Orchard reserves the right to grant accounts to others (e.g., prospective customers, channel partners, etc.) as it deems appropriate. All accounts are subject to the Privacy Policy and Terms of Use for the Website.

To set up an account on the Website, you must provide your name, account number, and email address. Orchard’s system automatically generates a unique password. After the initial sign-in, you may create a unique password to use for subsequent sign-ins. Usernames and passwords are stored in a secure database and are used to control access to the customer-only section of the Website and to provide a more personalized experience (e.g., welcome messages, account information, etc.). For added security, Orchard never has access to account holder’s passwords. You are solely responsible for the security of your password. After the initial sign-in, we strongly recommend you update your password and that you follow best practices for password security, including creating different passwords for each of your online accounts, using strong passwords, and changing your password frequently.

Cookies

Each time you sign into the customer-only section of the Website, it creates a temporary file, called a session cookie. When you close your browser, session cookies automatically expire, and they are removed from your machine. Your Web browser may allow you to be notified when you are receiving a cookie, giving you the choice to accept it or not. If you prefer not to receive cookies while browsing the Website, you can set your browser to warn you before accepting cookies and refuse the cookie when your browser alerts you to its presence. You can also refuse all cookies by turning them off in your browser. By not accepting cookies, some pages may not fully function, and you may not be able to access certain information on the Website.

Forms and Requests

Throughout the Website, you may choose to submit forms for various actions, such as requesting product information or contacting Technical Support. If you do so, you may be asked to submit personally identifiable information, including but not limited to, name, email, and phone number. This information will only be used to contact you about services on the Website for which you have expressed interest.

In order to download our product brochures, we request your name and email address. You may choose not to provide this information; however, completing these fields is required in order to view or download the information. Contact information will be used to contact you regarding Orchard products that you may find beneficial. Personally identifiable information collected via forms and requests is not shared with third parties.

Google Cookies

As part of our advertising campaign with Google, Google may record in the cookie it sets on your machine the keywords on which you searched to access the Website. If you do not want to have Google record this information, you must disable the Google cookie.

Log Files

Like many websites, Orchard’s Website servers create log files that list information about visitors to the Website. This includes Internet protocol (IP) addresses, browser type, Internet service provider (ISP), referring/exit pages, platform type, date/time stamp, etc. Orchard uses the log files to analyze trends, administer the Website, track Website visitors’ movements in the aggregate, and gather broad demographic information for aggregate use. If you access the Website from links in promotional material, the log file may contain information you have previously submitted. To disable tracking, you can adjust your “Do Not Track” preferences or settings for your web browser.  Personally identifiable information collected via log files is not shared with third parties.

Surveys or Contests

Occasionally, Orchard may request information from you via surveys or contests. Participation in these surveys or contests is completely voluntary, and you have a choice whether or not to disclose the requested information. The requested information typically includes contact information (such as name and mailing address), and demographic information (such as zip code). Contact information will be used to notify the winners and award prizes and may be used to contact you regarding Orchard products that you may find beneficial. Survey information will be used for purposes of monitoring or improving the use and satisfaction of the Website or other Orchard products or services. Personally identifiable information collected via surveys and contests is not shared with third parties.

Though Orchard makes every effort to preserve user privacy, we may need to disclose personal information when required by law if we have a good-faith belief that such action is necessary to comply with a current judicial proceeding, a court order, or legal process related to the Website.

Orchard does not share personal information with third party advertisers.

Business Transitions

If Orchard goes through a business transition, such as a merger, acquisition by another company, or selling all or a portion of its assets, your personal information will, in most instances, be part of the assets transferred. The Website may contain links to third party sites.  You acknowledge and agree that Orchard is not responsible for the information collection and privacy practices of such third party sites. Orchard encourages you to be aware when you leave the Website, and to read the privacy policies of each and every website that collects personally identifiable information. This Privacy Policy applies solely to information collected by Orchard on the Website.

Correcting/Updating/Deleting/Deactivating Personal Information

Because Orchard does not sell your information, there is no need to opt out of that practice. However, you may visit the Personal Preference Management Center to review and adjust your contact preferences.

Security of Information

Orchard takes commercially reasonable measures to protect your information. When you submit sensitive information via the Website, the information is protected both online and off-line.

However, we urge you to take every precaution to protect your personal data when you are on the Internet. Change your passwords often, using a combination of letters, numbers, and/or characters.

General Data Protection Regulation

Orchard is not subject to this regulation, as we do not target the European Union by the offering of goods or services to EU citizens, nor does Orchard monitor the behaviors of EU citizens.

California Consumer Privacy Act Compliance

Pursuant to the California Consumer Privacy Act and the California Privacy Rights Act (collectively, the “CCPA”), as may be amended from time to time, Orchard is providing the following additional details regarding the categories of personal information about California residents that we have collected (online and offline) or disclosed within the preceding twelve (12) months. This CCPA section does not apply to job applicants, employees, contractors, owners, directors, or officers where the personal information collected relates to their current, former, or potential employment or engagement with Orchard.

For purposes of the CCPA, “Personal Information” (which includes “Sensitive Personal Information,” as that term is defined under California law) is information that identifies, relates to, or could reasonably be linked with a particular California resident or household.
